Le Conseil supérieur de l'audiovisuel,
Vu la loi n° 86-1067 du 30 septembre 1986 modifiée relative à la liberté de communication, notamment ses articles 25, 26, 30-1, 45-1, 96-2 et 97 ;
Vu les décisions n°s 2003-298 à 2003-311, 2003-314 à 2003-317 et 2003-320 à 2003-323 du 10 juin 2003 modifiées portant attribution de fréquences de télévision numérique terrestre à des éditeurs de service de télévision à caractère national, notamment leur article 2 ;
Vu les décisions n° 2003-545 à n° 2003-548 du 21 octobre 2003 modifiées portant autorisation à des sociétés d'utiliser une ressource radioélectrique pour le multiplexage des programmes des éditeurs de services de télévision par voie hertzienne terrestre en mode numérique pour les réseaux R 2, R 3, R 4 et R 6, notamment leur article 3 ;
Vu la décision n° 2004-250 du 8 juin 2004 modifiée fixant la date de début des émissions des services de télévision à caractère national diffusées par voie hertzienne terrestre en mode numérique ;
Vu la décision n° 2005-30 du 18 janvier 2005 modifiée autorisant la société de gestion du réseau R 1 (GR 1) à utiliser une ressource radioélectrique pour le multiplexage des programmes des éditeurs de services de télévision par voie hertzienne terrestre en mode numérique du réseau R 1, notamment son article 3 ;
Vu les décisions n° 2005-116 du 30 mars 2005 et n° 2005-473 à 2005-479 du 19 juillet 2005 portant attribution de fréquences de télévision numérique terrestre à des éditeurs de service de télévision à caractère national, notamment leur article 2 ;
Vu la décision n° 2007-464 du 10 juillet 2007 fixant les modalités et le calendrier de l'extension de la couverture en télévision numérique terrestre des services de télévision mentionnés à l'article 96-2 de la loi n° 86-1067 du 30 septembre 1986 ;
Vu la décision n° 2007-478 du 24 juillet 2007 fixant les modalités et le calendrier de l'extension de la couverture en télévision numérique terrestre des services de télévision mentionnés à l'article 97 de la loi n° 86-1067 du 30 septembre 1986 ;
Vu la décision n° 2007-802 du 5 septembre 2007 modifiant et complétant la décision n° 2004-520 du 8 juin 2004 et fixant le calendrier de mise en service de fréquences attribuées à des services de télévision à caractère national diffusés par voie hertzienne terrestre en mode numérique ; Après en avoir délibéré,
Décide :
Article 1 JORFARTI000017787331
La diffusion des émissions des services de télévision à caractère national autorisés par les décisions des 10 juin 2003, 30 mars 2005 et 19 juillet 2005 susvisées, et mentionnés à l'article 96-2 de la loi n° 86-1067 du 30 septembre 1986 devra commencer :
― avant le 30 juin 2008 sur les zones figurant en annexe 1 ;
― avant le 31 octobre 2008 sur les zones figurant en annexe 2 ;
― avant le 15 décembre 2008 sur les zones figurant en annexe 3,
sous réserve que les réaménagements de fréquences nécessaires aient été réalisés.

Conformément à l'article 1er des décisions susvisées des 21 octobre 2003 et 18 janvier 2005, les opérateurs de multiplex autorisés doivent soumettre à l'agrément du Conseil supérieur de l'audiovisuel au plus tard :
― le 31 mars 2008 pour les zones figurant en annexe 1 ;
― le 30 juillet 2008 pour les zones figurant en annexe 2 ;
― le 15 septembre 2008 pour les zones figurant en annexe 3,
les sites d'émission permettant de desservir les zones figurant en annexe ainsi que les caractéristiques techniques concernant l'altitude des antennes d'émission et la puissance apparente rayonnée (PAR).

Dans le tableau annexé à la décision n° 2007-802 du 5 septembre 2007, la ligne relative à la zone de Gex - Nord-Est est supprimée.
